These Terms of Use govern access to and use of the website operated by Westrust (Pty) Ltd, trading as Westrust, at www.westrust.com. By accessing or using the website, the user agrees to be bound by these Terms. If the user does not accept these Terms, the user must stop using the website.
The website is intended to provide general information about Westrust, its people, practice areas and services in South Africa. The website is for information only. It is not a transactional platform, does not provide online appointment or payment functionality, and is not a client portal.
Website content is provided for general informational purposes only and does not constitute legal advice, insolvency advice, business rescue advice, restructuring advice, fiduciary advice, tax advice or any other professional advice. Users should obtain advice tailored to their own circumstances before acting or refraining from acting.
No mandate, retainer, engagement, fiduciary appointment, attorney-client relationship, advisory relationship, or other professional relationship is created merely because a user visits the website, sends a message through the contact form, or communicates with Westrust before a formal engagement is accepted in writing by Westrust.
The website is intended for users who may lawfully access it. Users may not use the website in any way that is unlawful, fraudulent, abusive, defamatory, infringing, harmful, or likely to impair the operation, security or availability of the website.
Unless otherwise stated, all content on the website, including text, layout, graphics, branding, logos, design elements, compilations and underlying materials, is owned by or licensed to Westrust and is protected by applicable intellectual property laws.
Users may view, print or download reasonable extracts for lawful personal or internal business reference only, provided that no proprietary notices are removed and the material is not modified in a misleading way. Any wider reproduction, republication, commercial exploitation, framing or redistribution requires Westrust's prior written consent.
When using the contact form or communicating with Westrust through website-published contact details, users must provide accurate information and must not send unlawful, threatening, malicious, misleading, defamatory or infringing content.
Recruitment-related materials should be directed to michelle@westrust.com. General website and business enquiries should be directed through the published channels for Westrust.
Users should not submit urgent deadlines, confidential instructions, large attachments, highly sensitive records or legally time-critical notices through the website unless Westrust has expressly agreed in writing to receive them in that manner.
Westrust may update, suspend, withdraw or change the website or any part of it at any time, with or without notice. Westrust does not guarantee that the website or any content will always be available, uninterrupted, error-free, secure or free from harmful code.
Westrust aims to keep website content accurate and reasonably current, but gives no warranty or representation that any content is complete, accurate, current, suitable for a particular purpose or free of errors or omissions. Commentary, articles, insight pieces and service descriptions are inherently general and may become outdated.
The website may from time to time contain links to external sites or resources for convenience. Westrust does not control and is not responsible for the content, security, privacy practices, availability or reliability of third-party sites. A link does not imply endorsement unless expressly stated.
Use of the website may involve the processing of personal information. Westrust's Privacy Policy forms part of the website framework and should be read together with these Terms.
To the fullest extent permitted by applicable law, the website and all content are made available on an "as is" and "as available" basis, without express or implied warranties of any kind.
To the fullest extent permitted by law, Westrust and its directors, officers, employees, consultants and service providers shall not be liable for any direct, indirect, special, consequential or other loss, damage, liability, cost or expense arising from or connected with the use of, inability to use, or reliance on the website or any linked site, including loss of data, loss of profits, business interruption or delay.
Nothing in these Terms excludes liability to the extent that such liability cannot lawfully be excluded under South African law.
The user indemnifies and holds harmless Westrust, to the extent permitted by law, against claims, losses, liabilities, damages and expenses arising from the user's unlawful use of the website, breach of these Terms, or infringement of any rights of another person or entity.
If Westrust believes that a user has breached these Terms or is using the website in an inappropriate or unlawful way, Westrust may take such action as it considers appropriate, including restricting access, blocking technical activity, preserving evidence, or referring the matter to the appropriate authorities.
These Terms are governed by the laws of the Republic of South Africa. Subject to any mandatory jurisdictional rules, the courts of South Africa shall have jurisdiction in relation to disputes arising from or connected with the website or these Terms.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as severed to the minimum extent necessary, and the remainder of the Terms will continue in full force and effect.
Any indulgence, tolerance or delay by Westrust in enforcing these Terms shall not amount to a waiver of any rights.
Westrust may amend these Terms from time to time. The latest version published on the website will apply from its stated effective date. Continued use of the website after updated Terms are published will constitute acceptance of the updated Terms.
Questions regarding these Terms may be directed to info@westrust.com or 010 446 0031. Formal legal notices should be sent to 104 William Road, Norwood and marked for the attention of Westrust management or the Information Officer, as appropriate.
